Brian’s Story:
Brian worked at the Defendant’s sand quarry. Whilst at work a pipe that was being moved by a colleague using a forklift fell from several feet from the truck and struck him on the head.
Brian was taken from the scene of the accident to Selly Oak Hospital. He sustained a concussional injury of his cervical spinal cord at the C3/4 level. The left side of his spinal cord was more damaged than the right. He had an immediate loss of movement on the left side of his body. The last normal level initially was C4.
Brian suffered tetraparesis (affecting all four limbs) that was motor and sensory incomplete. The left side of his spinal cord was mildly more impaired than the right. In the early stage following his injury his predominant weakness was on the left. He suffered with significant sensory issues on his right side.
An architect was instructed to assess Brian’s the suitability of his accommodation. As he already lived in a large bungalow he decided that he wished to remain living there with his family. Funds were secured in order to finance the necessary adaptions and equipment. A case manager was appointed to organise and manage his therapy needs. An occupational therapist was retained to assess and manage his equipment needs.
One of Brian’s primary interests was attending motor-cross and transportable All-Terrain Vehicles were sourced that would enable Brian to continue to enjoy his much-loved past-time. A suitable vehicle was purchased that enabled Brian to transport his new equipment. A neurophysiotherapist was retained to manage his physiotherapy needs and maintain his physical fitness.
Brian was represented by Leading and Junior Counsel, and a settlement was achieved that provided for both an immediate lump-sum damages, and annual payments (that increased as he aged) that met the cost of his annual care needs for life.
